In terms of Government of India Gazette Notification S.O. 2119 (E) dated June 26, 2020, the definition of micro, small and medium enterprises is as under:

(i) A micro enterprise is an enterprise where the investment in plant and machinery or equipment does not exceed ₹1 crore and turnover does not exceed ₹5 crores;

(ii) A small enterprise is an enterprise where the investment in plant and machinery or equipment does not exceed ₹10 crore and turnover does not exceed ₹50 crores; and

(iii) A medium enterprise is an enterprise where the investment in plant and machinery or equipment does not exceed ₹50 crores and turnover does not exceed ₹250 crores.

All enterprises are required to register online on Udyam Registration Portal and obtain a ‘Udyam Registration Certificate’. (Refer to circulars FIDD.MSME & NFS.BC.No.3/06.02.31/2020-21 dated July 2, 2020, FIDD.MSME & NFS. BC. No.4/06.02.31/2020-21 dated August 21, 2020 FIDD.MSME & NFS.BC.No.13/06.02.31/2021-22 dated July 07, 2021)

Further, to avail the benefits of the State Govt. of Odisha under various Policies/ Schemes, etc. the enterprises are required to obtain an EIN for availing of Pre-production benefits & Production Certificate for availing Post Production benefits. 

All Business activities – Services and Manufacturing are covered in the MSME sector except activities as mentioned in O.M. 5/2(1)/2020-P&G/Policy dated 17.07.2020.

MSME stands for Micro, Small, and Medium Enterprises whereas MSE stands for Micro and Small Enterprises and SME stands for Small and Medium Enterprises. In some countries, SMEs is more frequently in use. 

All services are covered under MSME except activities as mentioned in O.M. 5/2(1)/2020-P&G/Policy dated 17.07.2020. Accordingly, Travel Agency is covered under the Service sector.

As per para 5(3) of Notification no. S.O. 2119(E) dated 26.06.2020, the turnover-related figures of such enterprise which do not have PAN will be considered on a self-declaration basis for a period up to 31st March 2021 and thereafter, PAN and GSTIN shall be mandatory. 

The Ministry of Micro, Small, and Medium Enterprises vide Office Memorandum (OM) No. 5/2(2)/2021-E/P & G/Policy dated July 2, 2021, has allowed Udyam registration for retail and wholesale trade. Detailed guidelines are available in our circular FIDD.MSME & NFS.BC.No.13/06.02.31/2021-22 dated July 07, 2021. 

As per para no. 07  Sl no. (vi) of Odisha Startup Policy 2016, an entity shall be considered a “Startup” provided that- 

  • The date of its incorporation/registration is not prior to five years;
  • Its annual turnover does not exceed Rs. 25 crores, for any preceding financial year;
  • Such entity is working towards innovation, development, deployment, or commercialization of new products, processes, or services driven by technology or intellectual property and makes it scalable for achieving commercial success;
  • Registered in Odisha or employs at-least 50 percent of its total qualified workforce in Odisha;
  • Such an entity is not an extension of the existing family business; or formed by splitting up or reconstruction of a business already in existence and
  • Entity means a private limited company (as defined in the Companies Act, 2013), or a registered partnership firm (registered under section 59 of the Partnership Act, 1932), or a limited liability partnership (under the Limited Liability Partnership Act, 2002).” 

Various benefits are defined in the program each benefit has its own eligibility criteria. As a first step, the Startup will have to be recognized as per Odisha Startup Policy.

No, there is no registration fee required for the purpose.

All Approvals Relating To Services Required By Industries Is Given In A Time Bound Manner As Stipulated In OIFR 2015 And Odisha Right To Public Services Act 2012. 

As per para 15, Annexure-I, definitions &interpretations Sl no.02 of IPR 2015,  Ancillary Industry means an Industrial undertaking that is engaged or is proposed to be engaged in manufacturing or production of parts, components, sub-assemblies, tooling or intermediates or the rendering of services and the undertaking supplies or renders or proposes to supply or render not less than 50% of its products or services as the case may be, to one or more other industrial undertakings within the State.

As per para 15, Annexure-I, definitions & interpretations Sl no.03 of IPR 2015 Downstream Industry means an Industrial undertaking, which is engaged or proposed to be engaged in value addition of the intermediate or final produce or waste product of one or more industrial undertakings within the State utilizing a minimum of 50% by weight as base raw materials.
